Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Party Rally's website and services at partyrally.app (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Who may use the Service

You must be at least 13 years old to use the Service. If you use the Service on behalf of a group or organization, you represent that you have authority to accept these Terms on its behalf.

Accounts

Some features, such as creating and managing sessions, require an account. You are responsible for the information associated with your account and for keeping your login credentials secure. Notify us promptly at info.partyrally@gmail.com if you believe your account has been compromised.

Using the Service

Party Rally helps hosts propose times and collect availability from participants. You agree to use the Service lawfully and respectfully. You must not:

• Use the Service for unlawful, harmful, or abusive purposes
• Submit false, misleading, or impersonating information
• Attempt to access accounts, data, or systems without authorization
• Interfere with or disrupt the Service, including by automated scraping or overload
• Use the Service to send spam or unsolicited communications

User content

You may provide content such as session names, display names, availability responses, and feedback ("User Content"). You retain ownership of your User Content, but you grant Party Rally a non-exclusive license to host, store, display, and process it as needed to operate the Service.

You are responsible for User Content you submit and for ensuring you have the right to share it. Do not submit content that infringes others' rights or violates applicable law.

Shared session links

Hosts can share links that allow others to view session details and submit availability. Anyone with access to a link may be able to see information shared through that session. You are responsible for how you distribute links and what information you ask participants to provide.

Voluntary support payments

Party Rally may offer optional ways to support development. Any such payments are voluntary and processed by third-party payment providers. Unless expressly stated otherwise, support payments do not create a subscription, entitlement, or service-level guarantee.

Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time. We try to keep Party Rally reliable, but we do not guarantee uninterrupted or error-free operation.

Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Service, our users, or third parties. Provisions that by their nature should survive termination will continue to apply.

Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PARTY RALLY DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTY RALLY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PARTY RALLY IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) AUD $100.

Indemnity

You agree to indemnify and hold harmless Party Rally from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of Australia. You agree that courts located in Australia will have exclusive jurisdiction over disputes arising from these Terms or the Service, except where applicable law requires otherwise.
